NICE S.p.A. (“NICE” or “the Company”), the data controller for the personal data collected on the website www.yubiihome.com (together “the website”), devotes the utmost attention to the security and confidentiality of personal data in the conduct of its activity.

NICE may provide support and assistance to retail users (“Retail Users”) and automation sector professionals (“Professional Users”), each according to their needs.

Accordingly, in this document, NICE provides information regarding how it processes personal data concerning Retail Users and Professional Users.

HOW WE COLLECT YOUR PERSONAL DATA

This policy statement concerns cases in which NICE collects and processes personal data regarding you in the following circumstances:

  • you contact us to submit a request via the contact form available on the website;
  • you contact us by telephone using the dedicated telephone assistance number;
  • you fill in a purchase or repair form/order;
  • you provide your business card at a fair or in contact with the Company’s sales personnel.

The Company might also collect data regarding you in other circumstances, for example if you submit an application through the “Work with Us” page or participate in events organised by the Company. In all these cases, to which this policy statement does not refer, NICE will provide you with a specific policy statement according to the source of the data collected.

If you provide personal data on behalf of someone else, you must first ensure that the data subjects have reviewed this Privacy Policy Statement.

The Company asks that you help it keep your data up to date by informing it of any changes.

WHICH PERSONAL DATA REGARDING YOU MAY BE COLLECTED

The following categories of personal data regarding you may be collected (the term “personal data” is understood to mean all the categories set out below, collectively considered):

  • Contact Data – name, surname, address, telephone, e-mail address.
  • Sales Data – VAT number, tax code, IBAN and delivery address, if any.
  • Request Data – other data spontaneously submitted by you in the text field of the contact form relating to your request.
  • Telephone Support Data – information spontaneously provided by you in the event of a contact request for telephone support, submitted by contacting the dedicated number. Additional information, including the telephone number from which you are calling (where not private), IVR tree navigation data (i.e., the actions/entries submitted by the customer to access the various services) and call length, is also collected. Your image may be processed in the event of activation of video calls, where you grant your consent to enabling the use of your video camera. PURPOSES FOR WHICH YOUR PERSONAL DATA MAY BE USED

NICE may process your personal data for one or more of the following purposes, on the legal basis specified in each case.

PURPOSES COMMON TO RETAIL AND PROFESSIONAL USERS

a) Responding to a request submitted using the contact form on the website

NICE may process your contact data and request data in order to respond to requests, including requests for assistance, that you may submit by completing the specific form.

Basis of processing: execution of a contract or precontractual measures.

You must provide your data in order for your request to be processed; otherwise, we will be unable to fulfil it.

b) Telephone technical support

NICE may process Contact Data and Support Data to provide you with technical support service regarding our products, which you may activate by telephone contact using the dedicated telephone number.

You must provide your data in order to receive a response to your request; otherwise, we will be unable to fulfil it.

As part of the support service, you may be asked to activate your video camera in order to facilitate technical support personnel in assisting you. In this case, you will be asked expressly to enable the use of the video camera on your mobile device and you will be free to agree or refuse. Where you consent to enabling it, the Company might potentially process your image as captured during the video call.

In any event, the Company confirms that the sole purpose of enabling your video camera is to facilitate the technician in providing you with appropriate support. Accordingly, we ask that, where possible, you point the camera solely at the product for which you are requesting assistance, it being understood that the Company will nonetheless process any images of you for the sole purpose indicated above, without recording or storing it in any way.

Basis of processing: execution of a contract or precontractual measures. Where you voluntarily enable your video camera for support purposes, providing any images of you will be mandatory for the purposes of providing support service.

c) Protection of rights in judicial, administrative or extrajudicial proceedings and in disputes relating to the services offered.

Your personal data may be processed by NICE to defend its rights, take legal action or make claims against you or third parties.

Basis of processing: a legitimate interest of NICE in defending its rights.

d) Purposes relating to obligations established by laws, regulations or European legislation, orders/requests from authorities duly empowered by the law and/or supervisory and control bodies

NICE may process your personal data to fulfil its obligations.

Basis of processing: fulfilment of a legal obligation.

Providing your data for this purpose is mandatory since without it NICE will be unable to fulfil its legal obligations.

ADDITIONAL PURPOSES FOR RETAIL USERS

e) Marketing to provide you with promotional offers

The Company may process your Contact Data for the purposes of marketing and advertising communications intended to inform you of promotional sales initiatives carried out using automated contact methods (e-mail, text messages, other bulk messaging tools, etc.) and traditional contact methods (for example, operator telephone calls) or for market research and statistical studies, where you grant your specific consent, and within the limits of what is described in the relevant formula.

With regard to contact methods involving the use of your telephone contact details, we remind you that any direct marketing activities that the Company may undertake will be carried out in accordance with telemarketing legislation and the provisions governing the Public No-Call Register pursuant to Art. 130, paragraph 3-bis of the Privacy Code.

Basis of processing: consent, the refusal to grant which does not entail any consequences for contractual relationships.

ADDITIONAL PURPOSES FOR PROFESSIONAL USERS

f) Sending of technical/informational materials

The Company may process your Contact Data within the framework of the commercial relationship existing or being established with you, in order to send you technical/informational materials regarding our products, such as new catalogues, updated price lists, product technical specifications, notes and various informational materials regarding them. In managing the relationship, the Company may also process your Contact Data and all other information regarding you or included in the business cards voluntarily provided by you at fairs or similar events or in contact with the Company’s sales department. In such cases, the data concerned will be processed to respond to your request for information and send you the aforementioned technical/informational material.

Basis of processing: the Company’s legitimate interest in establishing and maintaining an effective commercial/professional relationship with you. This will be possible following assessments performed by the Company with regard to whether your interests, rights and fundamental freedoms that require the protection of personal data may potentially prevail over its legitimate interest to send you the aforementioned informational materials, inasmuch as the main reason that its legitimate interest may prevail lies in the common interest in providing the end customer with prompt, effective service in line with the Company’s standards.

HOW WE KEEP YOUR PERSONAL DATA SECURE

The Company uses adequate security measures in order to improve the protection, security, integrity and accessibility of your personal data.

All your personal data is stored on our protected servers (or appropriately archived paper copies) or those of our suppliers and is accessible and available for use according to our security standards and policies (or equivalent standards for our suppliers).

DATA STORAGE PERIOD

The Company retains your personal data solely for the time required to achieve the purposes for which it was collected or for any other related legitimate purpose.

Personal data concerning you that is no longer necessary, or for which there is no longer a legal basis for its storage, will be irreversibly anonymised or securely destroyed.

The retention periods for the various purposes for which data is retained are set out below:

  • Responding to a request submitted via the website and telephone support: personal data processed for this purpose will be retained for three months from when it is collected; in cases of telephone support, data may be stored for six months. However, any images processed during the course of a call will not be stored and will only be processed for the duration of the video call.
  • Execution of orders/contracts: personal data processed for this purpose will be stored for the entire duration of the contractual relationship and for ten years thereafter.
  • Sending of technical/informational materials: personal data processed for this purpose will be stored for up to 24 months from your last contact with us.
  • Marketing to provide you with promotional offers: personal data processed for this purpose will be stored for 24 months from when it is collected; however, we will periodically update your consent for this purpose in order to respect your choices.

In any event, for technical reasons, the cessation of processing and consequent final erasure or irreversible anonymisation of the related personal data will be final within 30 days of the end of the periods indicated above.

With particular regard to the protection of our rights in a judicial venue, or in the case of requests from an authority, the data processed will be stored for as long as is necessary to fulfil the request or pursue the protection of the right.

WITH WHOM WE MAY SHARE YOUR PERSONAL DATA

Your personal data is accessible to duly authorised employees and external suppliers, where necessary designated data processors, who provide support with the provision of services, including those necessary to the functioning of the website.

  • a copy of the personal data that you have provided (“portability”);
  • rectification of the data in our possession;

  • limitation of the manner in which we process your personal data, within the limits provided for in personal data protection legislation.

Right to object: in addition to the rights listed above, you may always object, at any time, to the processing of your data by the Data Controller in pursuit of a legitimate interest. Furthermore, you may always object at any time if your data is processed for marketing purposes.

Exercising these rights, which may be done using the contact details indicated in this policy statement, is free of charge and is not subject to any constraints of a formal character. Should you exercise any of the above rights, the Company will have the burden of verifying that you have standing to exercise it and to respond to you, generally within one month

Where you believe that personal data regarding you is being processed in breach of the provisions of the GDPR, you may lodge a complaint with the Italian Personal Data Protection Authority using the contact details available from the website www.garanteprivacy.it or take action in the appropriate legal venues.
